BEZZU.COM BUYER TERMS AND CONDITIONS
2. PURCHASING FROM THE SITE
By purchasing a Product from the Site, you warrant that:
- you agree to these Buyer Terms;
- you are legally capable of entering into binding contracts;
- you are at least 18 years old or above; and
- you will pay the Retailer for all Products purchased by you;
- you are not in any way prohibited by the applicable law in the jurisdiction which you are currently located to enter into these Buyer Terms.
3. DESCRIPTION OF THE SERVICES OFFERED THROUGH THE SITE
You understand and agree that the Products are not manufactured or supplied by or otherwise in the possession of Bezzu. The Site facilitates user interaction with Retailer's goods and services and enables user generated content and linking with user social media accounts on these products and services. The Site also facilitates the viewing and purchase of Products by you from the Retailers. The resulting legal contract is between you and that Retailer, subject to the Retailer terms and conditions (“Retailer Terms”) (if applicable), available on each Retailer’s page on the Site. You should carefully review any Retailer Terms applying to the transaction, as, to the fullest extent permitted by law, Bezzu accepts no responsibility or liability for the Retailer Terms or any resulting transactions, other than the display of advertisements and processing of payment on behalf of the Retailers.
We do not vet Retailers before allowing them to use Bezzu and we do not guarantee any Products sold or content displayed by Retailers or review Retailers’ listings or content. We encourage you to help us improve our service by reporting Products, Retailers or content which you believe may violate our terms and conditions and policies. We take such reports very seriously and will endeavour to deal with them expediently and appropriately.
All Products are subject to availability and so the relevant Retailer may not be able to supply your order. In unforeseen circumstances and, with or without notice, the Retailers may have to stop selling Products through the Site either temporarily or permanently.
Bezzu has no control over and does not guarantee the existence, quality, safety or legality of Products advertised; the truth or accuracy of users’ content, listings or feedback; the ability of Retailers to sell Products; the ability of Buyers to pay for Products; or that any Retailer or Buyer will actually complete a transaction or return a Product.
4. HOW CONTRACTS ARE FORMED BETWEEN YOU AND RETAILERS
Each order you place through the Site shall be deemed to be an offer by you to purchase the Product(s) specified within it from the relevant Retailer, subject to the terms and conditions of sale of the relevant Retailer and acceptance of your order will be deemed to take place once the Retailer has confirmed acceptance of your order in accordance with the Retailer Terms.
5. PAYMENT METHODS AND DELIVERY
Prices shall be displayed in the currency of the Retailer. For the avoidance of doubt, unless otherwise stated, all prices shown on the Site are inclusive of VAT or other sales tax applicable at the point of sale by the Retailer. Prices shown do not include the delivery fee, as advised by the Retailer, which will be added to your total order price. You are responsible for the payment of all import taxes and charges payable in the jurisdiction of delivery, if applicable.
Your shopping basket on the Site displays the Product(s) you have chosen, details of the Retailer who will supply them and details of postage and delivery options. The delivery costs for each Retailer vary according to the delivery methods they offer. You should check these details carefully before confirming the transaction.
Purchases may be paid for by using any major credit or debit cards (payments are processed using Stripe on behalf of Bezzu and the relevant Retailer).
6. REFUSAL OF TRANSACTION
Subject to applicable consumer laws, the Retailer may refuse to process a transaction for any reason or refuse service to anyone at any time at its sole discretion. We will not be liable to you or any third party by reason of such a refusal by the Retailer or by reason of unwinding or suspending any transaction after processing has begun.
7. DAMAGED ITEMS
If you notice any damage to items following delivery, please notify the Retailer as soon as possible after delivery in accordance with their refunds and returns policy. Nothing in these terms affect your statutory rights against a Retailer.
If you wish to discuss or organise a return, exchange or refund of any item, please contact the Retailer using the contact details notified by the Retailer. For further details, please consult the terms and conditions published by the Retailer from whom you have made the purchase.
Fair use - if we notice unusual returns patterns or activity we reserve the right to deactivate your account and any associated accounts. If this happens to you and you think we've made a mistake, please get in touch with Customer Support on email@example.com and we'll be happy to discuss it with you. Whilst we may deactivate your account, this in no way will affect or detract from your legal and statutory rights, which will continue unchanged.
9. OUR LIABILITY
Where you buy Products as a consumer, these Buyer Terms will not affect your rights under law against the Retailer which cannot be otherwise excluded.
9. DISPUTE RESOLUTION
In the event you have a complaint regarding a Product or service purchased from the Site, please contact the relevant Retailer. If you have not been able to resolve your issue directly with the Retailer, please contact us at firstname.lastname@example.org
In the unlikely event that the Retailer is unable to resolve your complaint and you are still not satisfied following the conclusion of the Retailer’s complaints handling procedure, you may refer your complaint to your local consumer protection authority (in Ireland, the Competition and Consumer Protection Commission) that maintains a list of Alternative Dispute Resolution (ADR) entities.
For EU consumers, the EU Online Dispute Resolution platform is also available for disputes relating to products purchased online from EU traders at http://ec.europa.eu/consumers/odr/. Please note that, following submission of your complaint on the EU platform, you will be directed to a listed ADR entity.
10. GOVERNING LAW
These Buyer Terms are governed by the laws of Ireland and you agree to submit to the exclusive jurisdiction of the courts of Ireland. Nothing in these terms affects your statutory rights.
